MonaVie Hit With Class Action Lawsuit in Arkansas

October 29, 2011

Received this from a reader today regarding a class action lawsuit — instigated by a certain Joe Neal Oliver — against MonaVie:

Legal and Compliance Update

MonaVie is committed to following and complying with all state and federal regulations. Recently, MonaVie was named as a defendant in a class action lawsuit filed in Arkansas state court. The lawsuit alleges false advertising on the part of MonaVie. However, MonaVie vigorously disputes these allegations and is seeking a dismissal of all claims made. The Arkansas court has instructed MonaVie to provide independent distributors of MonaVie products with certain materials, which include a copy of the complaint and a document preservation order. These two documents, as well as MonaVie’s response to the lawsuit, may be accessed by clicking the links above.

’tis a beautiful thing!! I hope that they have solid evidence that Monavie is completely aware and sanctions the misleading advertising put forth by their own.

NOW we are GETTING somewhere folks! I hope that this law suit attracts the attention of the FDA and FTC!!

The prophecy has been fulfilled. This is music to my ears. The suit alleges conspiracy and fraud on the part of MV and its executives. Not only should this be brought to the attention of the FDA and FTC (assuming it hasn’t already) but the media as well. This lawsuit should attract some serious attention. I’d venture to wager that this is the death knell for Monavie.

Just for laughs, have a look at what Kevin Thompson had to say about the case.

“The lawyers in Arkansas better have some serious cash because they’ve just signed up for some ridiculously expensive litigation.”

The lawyers are presumably doing this pro bono based on a very firm belief that they will ultimately prevail in the case. The suit also stipulates that MV would be on the hook for the plaintiff’s legal expenses. Ultimately, I think it’s MV that better have some “serious cash” on hand — to pay for the attorney’s to defend them in court and, ultimately, to pay restitution to the victims. Also, bear in mind that this could easily spread beyond Arkansas. MV could find itself facing similar lawsuits in other states or even at the federal level.

“Proving that there’s a pattern of misconduct amongst tens of thousands of distributors will be a challenging task and require some substantial discovery.”

We all know for a fact that there IS a clear pattern of misconduct; it originated from the top and spread throughout the organization. Proving it should be easy, given that it’s a fact. Defending against the charges will be the real challenge.

“Plus, MonaVie takes health claims very seriously with its compliance department.”

We all know that this is complete and utter BS. The only time MV would take such matters seriously would be if they thought they were on the verge of facing direct consequences as a result of the conspiracy/fraud. As the lawsuit alleges, MV could have stopped such false advertising long ago but didn’t. They haven’t do so because false advertising is the foundation of the scheme.

“If they can demonstrate a long history of disciplining distributors making inappropriate health claims, they’ll argue that the facts referenced by the Arkansas lawyers are isolated incidents.”

If they try to argue that, they will lose because it’s clearly untrue. These are not isolated incidents. They are the very core of the company. Any success that MV ever achieved has been predicated on lies and fraud. Furthermore, in some cases, the company itself and/or kingpin distributors have been the source of the fraudulent claims or have openly encouraged them (e.g. Brig Hart in the Jeff Bodine video, Jason Lyons in the disastrous Lou Niles video fiasco, postings on the company’s website, distributor training recordings featuring Larsen himself, etc.).

“Plus, as we’ve seen with other class action cases against network marketing companies, one of the best tools to use is the media. Where was the media attention to this one? Either I’ve been sleeping under a rock or nobody knew about this.”

It’s not clear whether Kevin is referring to media attention the class action suit or to the fraudulent marketing of MV. If it’s the latter, then we can all assume that Kevin has been sleeping under a rock. Forbe’s magazine referred to MV a pyramid scheme; Newsweek referred specifically to some of the same fraudulent advertising that was highlighted in the class action. Men’s Journal showed the juice was basically nutritionally worthless. Huff Post, the Palm Beach Post, and Andrew Weil also published articles that were critical of MV. But Kev is right in one aspect — there would be great value in bringing this class action to the attention of the media.

“It was filed in December of 2010! If this case is being litigated in a vacuum, MonaVie can fight this one all day everyday”

Meaning what I wonder? Yes, Monavie can TRY to fight this…so what? Whether or not they fight it in “a vacuum”, the facts are against them; the media is against their; own distributors are against them. The FDA is against them (e.g., the mishap with Kevin Vokes — who, incidentally, is still a distributor). Now that this is out in the open, the damage is done. Regardless of what happens in court from here on, I believe that the harm to MV’s already poor reputation will be irreparable and that this scheme will now unravel rapidly.

It cracks me up as to how ignorant we Americans can be. The first thing that all Monavie distributors learn is that Monavie does not make claims that it can cure, treat, or prevent anything. With Dallin receiving Entrepreneur of the Year by Erngst and Young and Monavie showing up as 18th fastest growing business in the INC 500 they have a great reputation.

As the excerpt above (that was sent to distributors by the company) states “MonaVie. However, MonaVie vigorously disputes these allegations and is seeking a dismissal of all claims made.” I am sure this is what the outcome will produce.

Only 6 years in business and creating more than 100 millionaires, Monavie has done wonders for local economies all over the country.

When will someone uncover the biggest scams of our times, College Education and Pharmaceuticals.

The litigation Monavie is pursuing against Philip Loh in Asia is equally interesting, and just as potentially damning to their reputation. Mr. Loh had his business stolen from him because he maximized the compensation plan (built a perfect 2X2 pyramid), which would potentially ‘break’ the compensation plan in Malaysia. I have connected with him and will see if I can bring Dr. Loh onto the blog and share his story, it is totally insane.

  6. October 29, 2011 1:33 pm

I’m really glad that I tested their compliance team with Mitch Biggs and his Swine Flu stuff now: I wish there was a way to contact Joe Neal Oliver.

I think Mr. Loh left a few comments on the JuiceScam blog, but if memory serves, English wasn’t his first language and I had some difficulty understanding what he was trying to tell me.

I think that in the distributor agreements there’s usually a clause where MonaVie can terminate a distributor for any reason. If so, I wouldn’t imagine a lawsuit would help.

LM, maybe this is too obvious but you could contact his attorney’s that are listed on the bottom of the complaint? Looks like there are a few law firms involved?

I’m still reading the complaint. I didn’t get to the bottom yet ;-).

I hope there’s an email address at the bottom.

Lazy Man, MV is actually suing Dr. Loh. He pushed through approval of the juice for them in several Asian countries because of his connections. Countries, by the way, that MV was having difficulty getting into. He then went to MV to seek a little compensation for his efforts, and they shit-canned him. A jealous move I believe because he was smart enough to register the product in his name within the countries, which was a totally brilliant move. He thought the registrations were an insurance policy which would protect him. He expected a thank you and a pat on the back for his job well done, but instead he got the shaft. I think Dr. Loh is the man, because he isn’t afraid of them in the least bit. Total champion, and it will be interesting to see how is case evolves.

Think of all the millions of bottles they could have moved into China, but their contempt for Dr. Loh was larger than their desire to share the spoils.

He maximized their comp plan as well, (perfect 2X2 pyramid breaks a binary) which they teach you to do, but never expect anyone to be capable of. He was called in by corporate and was told that he was maximizing the plan, so they needed to let him go, but then reported to their minions that the reason he was dismissed was for illegally taking product into unapproved territories.

  10. October 29, 2011 5:14 pm

Having heard what Mr. Loh did (and it reminding me of his comments on, it sounds like MonaVie is technically in the right. I think it comes down to whether Mr. Loh had authorization to distribute in the countries he did. It sounds like he didn’t. MonaVie has a procedure for entering new countries, and I think part of that is selling the rights to be the first.

If Mr. Loh just entered China and started signing people up, MonaVie probably lost a ton of money from getting another distributor to pay millions to be top guy.

Even if the reason he was dismissed was because he was because he was building a perfect pyramid, it seems to me that they had a perfectly legal reason to dismiss him.

I like anyone who attacks MonaVie, but I would call Mr. Loh a champion if he did it while following MonaVie’s letter of the law. It seems to me that it is a case of two wrongs and I’m not sure there’s a right to be made there.

    Lazy Man,

You are right, and I do not dispute the fact that he acted against the MV P&P.

Interesting enough this whole fiasco has created an ugly situation in Malaysia.

To me, the humor in this lies in the fact that he was able to do in short order what MV had spent substantial time and money in unsuccessful attempts. I would have loved to see Dallin’s face when he discovered that China approved MV to come into the country, but not with MV as the registered importer. How would you have liked to have been a fly on the wall at MV corporate on that day.

Although Dr. Loh got the cart in front of the horse, I find the whole situation funny, because their own greed has cost them the market for now. And wouldn’t have any “traditional” business owner have been thrilled to death to have the potentially largest market in the world approve your product for import, and open for business?

But not in MLM, it goes against protocol to have someone like Dr. Loh, someone with a “I am gonna get it done attitude”. He was foolish enough to believe that MV was only about selling product, increasing revenue, and market expansion He should have known it was about positioning the “chosen ones” to maximize the entire model. Can you imagine how excited Dr. Loh was to report back to the overlords that he had accomplished the nearly impossible, only to be slapped down?

And of course Lazy Man, you are probably correct in assuming that new markets are all about the money. when they are entering to fleece the poverty stricken masses, this presents a fantastic opportunity for them to line someones pockets even more. I would love to know what bastards are lining their pockets now that India and Hungary are opening. Of course it is probably the dynamic foursome, who have also been called out for false income claims, you can see their paid self promotion here.

I feel for Dr. Loh’s loss, I think he is a stud for having the guts to butt heads with MV, and I hope he is able to shut down their importing into China indefinetely.

  12. October 29, 2011 7:00 pm

If you’ve been following MonaVie for 3.5 years as I have, MonaVie missteps are expected… and while on one level humorous, on another sad (due the fraud involved). To paraphrase Mal in Serenity, “I never credited MonaVie with an overabundance of brains.”

They threatened to sue me twice. Both times, without a lawyer, I was able to publicly embarrass them.

I also feel for Dr. Loh’s loss, but I have to believe that he knew what was going to happen when going into the lion’s den. It might have been reasonable to think that MonaVie would have embraced his efforts, but I hope he was smart enough to know that when you play with fire, you have a good chance of getting burned.

You heard what happened when MonaVie tried to go into Germany right? They kicked them out for essentially being a pyramid scheme. It’s a small footnote in MonaVie history.

I’m trying to dig into my memory here, but I’m pretty sure I read a letter about 2 years ago from the FTC to Monavie – a warning to tone down the health claims? I was trying to search for it on the FTCsite but can’t remember where I seen it. I also remember while reading it I passed it off as “oh well, every company gets some form of warning or other from them picky (FTC) guys”

Can anyone else find it at all?

I believe you are referring to the July 6, 2007 FDA Cyber Letter warning to Monavie and Kevin Vokes (one of the first recruits in Monavie since pre-launch days). Such warnings are sent out when the FDA discovers advertising content that violates US laws regulating dietary supplement health claims.

    Click to access ucm056937.pdf

The way Monavie sloughed this off was to claim that the warning involved Vokes only and not the company itself; claiming that they were sent a copy of the warning merely as a courtesy. This is laughably untrue of course. The company was included on the warning because they are ultimately responsible for the conduct of their distributors.

I see a great analogy of the Titanic surrounding; the many warnings and then the of denial of many who believe that the Corporation, ‘Top’ Executives including the Top guys ‘training’ (systems) and others who, make a killing around the MLM industry, who try and deny and avoid any responsibility. Including; the false claims and every single thing else that is being touted by every ‘distributor’. As if, the ‘top’ are not the ones responsible for sending these messages and ‘training’ them, it is spewed from stages, cds, personal time, with the (mis)leaders, special qualified meetings, etc. and then are simply ‘repeated’ by those distributors. Anyone, who denies this, is flat out denying the truth.

The sole reason, every distributor ‘repeats’ what they hear, is because that IS the way the business is designed (dictatorship) and followed. It is a hierarchical system where the information comes from their messages; that say what they want you to say in a very clever, manipulated, and protective (carefully selected/protect them from the LAW words) and flows from the top down. It is based on ‘modeling’ what they say, think, and do and it is evident in every post on any website that defends the MLM! ‘Share it’, meaning I didn’t tell you to make false claims BUT; Share your story of what the ‘system’ and ‘juice’ have done for you personally. Anyone who denies this…is blind or intentionally tries to ‘port around it.’

And so they (all distributors) model their stories after what they have seen and hear others say. I have heard Dallin, say himself, share your ‘story’ of what MV has done for you. Then they put in their P&P’s and send little messages out saying you can’t say this or that to make it ‘appear’ they are doing everything legal to inform those ‘followers who model exactly what they see and hear’ and in the next breath…They Model and Breach; their very own contracts. No? Spend a decade around it and Go to seminars.

So, as I said; it is like the Captain of the Titanic being warned numerous times, and then finally to hear the “Iceberg is a head” (lawsuit) and ‘intend to port around it.’

And so it goes with all the people speaking out are the ‘warnings’ and have been for decades and then the lawsuits begin..”The iceberg is ahead!”

So do they ‘intend to port around it?” And finally…Discipline comes from within (you take responsibility) or it comes from without (numerous lawsuits that will either crush you, shut you down or force the change). At some point it becomes too late to cry wolf….that you are not responsible. Eventually you self-destruct.

Please bring the list and facts. That certainly would be a great feat. Where is this list (names) of all 100 millionaires and facts of the full discloser on they became millionaires through MV solely and how they have changed the local economy?

If this is true and this has been accomplished in MV (alone) and they are still millionaires, from MV, then their should be a media article, MV article listing all these millionaires?

Did they become millionaires IN.. MV or did they build these teams and became millionaires in another MLM (prior) and then moved to MV and then Monavie has claimed they did this themselves,is all of this disclosed? Are they still millionaires as of 2011 without any other ‘conventional’ business investments and monies from other sources they have invested in, and changing the local economy? Are those 100 millionaires still with MV or have they left to another MLM?

Do you know what creates ingnorance? The MLM industry from my experience…lack of truth and knowledge, and in cases from my experience it is intentionally with held information or partial info. only given, which in fact, is notorious in my experience.

“So do they ‘intend to port around it?””

Of course not! Not if history tells us anything!
Larsen has a public history of jumping ship before it goes down with all hands. You gotta know the timing of his departure has been a part of the scheme from the start. The cons absolutely planned for the day that the law would finally come after them: They simply plan to skip town and be on to the next con by then. Isn’t that the way slippery criminals have operated since the dawn of time? And since Larsen got away with this before, why wouldn’t he come back for more? And even more brazenly?

Discipline and responsibility have never been a part of a confidence scam.

Maybe a prison sentence would help Mr. Larceny to finally see the error of his ways. The Feds threw the owner of Metabolife in prison. Same thing with Metabolife’s key ingredient suppliers Chemis (owner sent to prison). Maybe he can say hi to Lou Niles the child molesting Monavie spokesman/doctor impersonator, because that’s where Lou is headed too…for a long, long, time.

One last point…The Corporation Top Execs. ‘promote’ everyone to follow whatever ‘training company’ and their material and the training companies have been Approved by them, mind you…and hundreds of millions are PAID to all of these ‘training companies’ and isn’t this the REASON for the distributors to be ‘trained’? These so called ‘master trainers’ including the Corp. training seminars And NOT ONE of these highly specialized Gurus can prevent the illegal activitiy?

Could it be those hundreds of millions that the distributors Pay for, are too busy sending other messages and using thought reform techniques..and calling it ‘training?’

They have NO problem and can get ANYONE to repeat Every single hyped up thing they say and promote…but can’t get them to STOP claiming illegal medical claims, incomes claims and all else that is required by the Law? It is amazing to me how any judge or human being would not see this considering the massive training these MLM compaines are supposedly ‘suppling.’ to this industry!

If they actually TRAINED…and quit trying to ‘motivate’ and hype, deceive etc.. at every single seminar, and put as much emphasis on the P&P and following the LAW as they do with their self-proclaimed guru status, edification, and ‘you can be a millionaire too’ BS… financial freedom.. dream and other mind altering tricks, then they wouldn’t have distributors breaking the law for them.

This is an easy fix and they all know it!

  21. Speak Your Truth permalink

Those ‘cats are herded’ at a very minimum 16 times a year in some ‘intense’ training seminars and majors (3 days long).. Alone.. just for ‘training’!

This is not including ALL the other meetings PP, RT, Conference Calls, ‘fun’, by these Expert ‘trainers’ and all those cats are ‘trained’ by listening to those ‘same’ cds from those seminars at least 3 times a day..(according to the LieF training ‘all in’ program). Pretty sure they have more than ample ‘training’ to get the cats to follow the law. What do we know?.. Ha..We were ‘trainers’…lol!

This is how ridiculously absurd the ‘training’ systems really are! … ONLY in the MLM industry can these companies claim with hundreds of millions of dollars being spent on ‘Training’; can they get away with saying they can’t ‘control’ what others do and say.. when in reality they control everything these distributors repeat, do, think, wear, time, money etc. and they have had 5 years of ten’s of thousands in training!

The fix isn’t send ‘compliance’ in and ‘tell’ everyone what the ‘rules’ are; it HAS to come from the Trainers that are snickering under their ‘breath’ the whole time the ‘compliance’ is telling them what is required and as soon as the compliance people leave…back to buisness..Don’t change a thing…keep doin what we have always done! This happened in Q/Amway and is happening here too and across the board!

When will the ‘training systems’ be held accountable for ‘Training?’ What a farce.

  22. brent hansen permalink

That is because no matter how hard they try to train, all the training in the world cannot make the untrue become true. By having a compliance dept. and a proper P&P in place, companies have a big CYA umbrella to protect them. Do you really think that MV couldn’t shut down all the juice being sold on ebay if they wanted? When I was at MV corporate, someone from compliance came in and talked about their rigorous ebay campaign they had going, and how it was all getting under control. Hahahahahaha!

I remember in A/Q the member-client volume reporting, and what a joke that was. But, it gave A/Q a great big CYA as well. I recall reading how it was up to those at the Platinum level to enforce the MC volume reporting policy within their personal teams, and to make sure those reporting were really making customer sales. It would have been real easy as a Platinum to have the blame land directly on you if the rule was ever enforced, and I believe that the corporation would have hung you out to dry if they were ever taken to task.

Bottom line is most companies simply want to move product, as much as possible, wherever possible, but will always have compliance to legitimize the scam. This shouldn’t matter anyway psssshh….. because according to the DSA, 70% of those who join simply join to get a discount on the product anyway. They fall in love with the product, and want a better deal.

Kind of ironic, because my enrollment in MV went something like this, (phone ring) I answered, “hello”. My upline, “Brent we need your credit card number, we are going with Team in Monavie, and you need to buy 2 cases of juice.” My response, “what juice?” “What is Monavie?” The answer, “Ah Brent it doesn’t matter, we are following Orrin, and we are gonna get rich.” “Do you want your spot or not?”

Now, does that sound like I fell in love with the product and just wanted a discount? Not hardly! The ol “just enroll for a discount” is one that the industry apologists continue to throw in our faces, but doesn’t hold any water at all. If it did, I would love to see someones back office who is no longer building the business and check their volume to see how many people are “just getting the product at discount.”

I am sure that Life will be different though with this incredible, super duper, life changing information promoting the purchase of more information. People are going to join just for the discount alone, let alone the miraculous changes that will occur in their lives.

    Am I too negative?

Including their memo’s of exactly what to say when thousands ‘resigned’ to go into that…surprise!..Wal-Mart of the Internet Co… called MV!

Our whole group falls into your ‘theory’ according to the DSA guys that must evaluate your’s and our business’ of buying the product because they loved it, along with all the other 99.9999% of the rest of the ‘buyers’.. it certainly wasn’t because they were told to ‘buy from themselves’ and believed they would get PAID those Big buckets of cash.. if they didn’t!

Hahaha..I remember Orrin loved to say it wouldn’t matter if I/you had to ‘bury those products in your back yard’…if you could have the lifestyles of the Diamonds!! Whooo Hooo!..Just a heads up if you purchase a house from a old Team.. Positive Energy, you REALLY need to do a little more reading/researching. It has been mathematically proven that about .05% of people involved in Monavie actually make enough to cover the cost of the juice (these pesky facts always get in the way of the perfect scam, I mean dream). I guess that means that over 99% of your fellow distributors are dismal failures? Interesting, they are not writing “negative” or “hating” such as we are (we prefer to call it imparting “truth” and “reality”) but they are not “successes” in your eyes. So, i guess your “law of attraction” theory doesn’t work,YO!

Let me tell you what the love and peace in my heart led me to do. It led me to STOP ripping my friends and family off by sucking them into this sham/cult/scam/pyramid scheme. It led me to refrain from selling them fruit punch that is hideously overpriced and would NEVER sell in a retail market. It led me to do what any sensible person would do and to some independant research on the company, the product, the people involved and really be honest with what I found. Shoot, that dang blasted “honesty” thing keeps slapping us in the face, doesn’t it?

Bottom line is that you shouldn’t be applying the “law of attraction” to this because, even if you were successful, which I HIGHLY doubt, you are basically using your powers for “evil” in that this business is pretty close to being criminal activity.

Oh, and sweetheart, I have read every positive book out there and NOT one of them supports scamming your friends and family so please give your head a shake. Eckhart Tolle would be insulted having his name smeared by associating it with this industry. Are you “positive” about having child predators in your neighborhood? Are you “positive” about drug trafficking? Are you “positive” about Bernie Madoff? No different my friend, no different. I had to learn the hard way, and you will have to too but at LEAST take the first step and get the hell off of the site or Troy Dooly’s “bullshit desk” and do some independant research.

Or not. Your choice. But don’t you dare come on here and insult my friends by calling them insane.

Amthrax…I wasn’t sure where this would fit but it is a great article on LM about MV layoffs when they have been writting articles on how they are a ‘solution’ to underemployement and employment..the part of the article from an ‘insider’ in MV, is very telling:

Are they trying to say MV does not cure everything from bad breath to bringing the dead back to life like I was once told? 🙂

Monavie Malaysia is facing some issues with the Ministry of Domestic Trade and Consumer Affair of Malaysia and Ministry of Health of Malaysia. Too many complaints have been received by the Ministers, they also facing the Halal issues with the Malaysia Department of Islamic Development (JARKIM).

Monavie Thailand will also face closing down, on 2011.11.23 (Bangkok, Thailand), while a group of Monavie leaders having an products and opportunity meeting at Bangkok, they have over claimed the functions of the products that can cure many different type of illness, the whole session was recorded by Thai FDA and the leaders were caught red handed by the FDA officers.

While waiting at the Bangkok FDA office, hoping that someone from the corporate will turn up to help them, Doug Whitehead, Monavie LLC USA legal attorney appeared.

Unfortunately, Doug Whitehead was at the Thai FDA to declare Monavie never claim their products can do wonders, and left without billing out the leaders under detailed.

Now Monavie is giving the last stab to their almost dying business in Thailand, the leaders will definitely no longer trust Monavie, and worse still, they will have to shut down their operation in Thailand in no time.

This will be the same case for Monavie at India……….

As a TEAM IBO we spent about 6 years in the business to get to the point of speaking at the Tuesday night meetings. My problem with TEAM of Destiny and TEAM was that they changed the system a few times. Just before they did the Leaders would push a lot of tools and people would spend hundreds or thousands on tools for the tools to become obsolete within a week or two. I have a problem with this! This was not ethical and I feel terrible that others followed our example and bought more tools. It has occured to me later after leaving the business that people thought that we mislead them. This thought haunts me. The proper thing would have been for the Team to return these items. I have thousands of dollars worth of useless tools. Also to think of all the time we spent away from our children to build the business. We cant get our time back with our children 8 and 7 years old at the beggining. We were taught that we were in control of our success and the time and effort we put in would determine our success. We had built a good foundation of a business to have Quixtar and the Team part ways. Our Team lost hope on all the promises of something better to come along. We had no control over our Team falling apart.
To be truthful, I am bitter about this. I will not be mislead again.

Thanks for sharing. I am sure it would be only a very small part of your story, especially after 6 years! It does help to have others that have been where you and give some understanding, so I hope you find some peace because you are not alone on this site. I think you will find many comments on here from most who have shared and feel the same as you. I was wondering what prompted you to come here to share or how you found this site? Thanks we are all here for you.

On the another note and on the topic of this thread; I am wondering if anyone has heard anything about the lawsuit with Mr. Oliver vs Monavie?

I have copied and pasted part of webelieved’s comments about the lawsuit where many people have an opportunity to recoup some of those loses and a link to the page you can get more information. In this thread, there are comments of some justice coming. At least we can have some peace knowing people can recoup some of their losses, now!

I am so with you on the “thoughts that haunt” because of misleading others. When the moment came for me (waking up) and that fact hit, it is torture. It tormented me for a long time and still does to a certain extent. I also have realized that self-forgiveness does come, after a long excruciating process. Just know, those who have a conscience have experienced the same thing and those who continue well, imo have chosen to ignore their conscience and they will not escape it, no matter how much they ‘justify’ it. Also know that you stopped when you realized it was hurting others and did what you were falsely led to believe was ‘helping others’.

Unfortunately, greedy people become desperate and do not do the right thing when they think they will lose their cash cow. At least it seems that some need to be hit in the pocket book, but regardless I hope they all are brought to their knees and held their until they can be and remain humble. It may take some losing it all! I am sure your team got notice of this lawsuit and should take the opportunity to recoup those losses. This is big news at least for me, it has made me feel a whole lot better knowing they will get some losses back. I realize that ‘time’ is the most precious and can never be given back, but I have been reminded through my experience, what I already knew but got lost in the illusion, was that that the most important things do not cost anything, and if something is pushed as too good to be true, then it is! Good luck hope you feel at least a little better knowing your team will recoup some $$. I am also with you are the rebranding so many times that created so many loses, but we all know the greedy PC, knew this full well and without a twitch they perpetuated tens of not hundreds of thousands of dollars of losses on those they said they would NEVER hurt and were out for their best interest. Sure says a lot about their character and how much they ‘cared’! Maybe they just failed to say the only thing they ‘cared’ about was their Bank Accounts!

Here is the information, I spoke of that I copied and pasted, at least Quixtar, now Amway is paying, Orrin and the PC, need to get a clue!

“……If You Were an Amway/Quixtar Distributor at Any Time Between
January 1, 2003 and February 21, 2012 You Could Get Benefits from a Settlement.
“…. A lawsuit was filed against Quixtar, Inc., (“Quixtar”) over its pricing of goods and its recruitment of Quixtar distributors, whom the company calls “Independent Business Owners” (“IBOs”). Quixtar denies that it did anything wrong. The Settlement includes $34 million in cash, $21 million (retail value) in free products, and a legal commitment from Quixtar that it will change certain business practices. Go to for more information and to file a claim online.

    Who’s Included?
You are included in the Settlement if at any time between January 1, 2003 and February 21, 2012, you were an IBO or a legal entity through which an IBO conducted a Quixtar-related business.

    What Can You Get?
Former IBOs who quit Quixtar before February 21, 2012 may be eligible to receive a cash payment and/or free products. Former IBOs may be eligible to get (1) up to $75 in free products if you paid a registration fee which was not refunded and if you did not renew your Quixtar distributorship; (2) up to $2,000 to repay you for the purchase of business support materials, and (3) up to $10,000 if you lost more than $10,000 or filed for bankruptcy because of your participation as an IBO. Current IBOs are not eligible to receive compensation from the Settlement, however, they will benefit from certain business reforms.
    How to Get Benefits?

You must submit a Claim Form to get benefits. The Claim Form is available at or by calling 1-888-334-6149. You can submit a Claim Form online or by mail. The deadline to submit a Claim Form is August 17, 2012….”

Welcome here and thanx for sharing your story. It’s a good start.

I too was haunted by the fact that I participated in misleading people as many ex-mlm cultists often realize.

Granted, I was unknowingly misled – perhaps I trusted too blindly too quickly and was really really wanting to believe it’s true, God ordained yada yada – and I exercised the same on other unsuspecting individuals. That’s the reality of it. But when I realized it I knew there was only one right thing for me to do. I seeked out my direct and indirect victims to vehemently apologize, no buts or ifs and share with them the truth about the scourge of mlm. It’s an effort I still continue with as I happen upon each one.

Gladly unbeknownst unto me, this act was vital in my coming to terms with everything that happened. Thus, I cannot stand by idly as MLM charlatans continue to entice and entangle, razzle and dazzle those starry eyed in our midst with the pestilence of their evil, pernicious, specious, sanctimoniously pretend businesses. How can I, how can we, those of us who have seen through mlm, after this fact of exposure, the real of it without all the fluff.

My biggest drive was my own amazement (and I was very very flabbergasted too) that I, and so many others, time over got taken as we were. Consequently, it became incumbent upon my good self to embark on an earnest endeavor to uncover why I never saw through the lie of mlm (no worry about that or similar mistake ever again!), to understand it and to have proper knowledge if only to warn off and prevent others from the scourge of mlm, I discovered your story at this site and elsewhere, over and over, just with a different name each time.

Thus, as many others on here I get total fulfillment to see you where you are now, no less than I do when others discover this truth before venturing into this puerile ahem, “industry”; not to mention a modicum of another coming to terms step, and they do add up.

You will find your own way as we, exambots, all have no less as time as well will be a good friend just as many on here will be. Good luck!
